BIKEBOX-FINALE – Terms and Conditions of Service

This contract establishes the terms and conditions for the use of the protected and supervised private bicycle storage service called “BIKEBOX-FINALE”, made available to users by the company BIKE BOX DI GHISELLINI ALBERTO (hereinafter BIKE BOX) – VIA DOMENICO BRUNENGHI, 39 – 17024 – FINALE LIGURE (SV), VAT number 04015090048.


DEFINITIONS

BIKEBOX-FINALE: This is the protected and supervised storage service for private users’ bicycles. The User is authorized to use the service upon booking, by filling in the appropriate form on the website www.bikebox-finale.it. Following the booking, the User will receive via email a specific authorization code that allows them to retrieve, from a Keybox located at the facility, a coded access key to the reserved box.

BIKE STATION: This is the infrastructure made available to Users by the service. It consists of a storage facility with 10 metal boxes intended for bicycle storage. The Bike Station is a protected structure (in an enclosed space, with access via a coded key) and monitored by a video surveillance system.

BIKE BOX: This is the space measuring 0.95 m x 1.25 m x 2.10 m, constructed in metal and equipped with a dedicated coded key, inside which a hook is provided for hanging the bicycle. Each box accommodates one bicycle only. Inside the box there is an electrical outlet for charging electric bicycle batteries.

CODED KEY: This is the key, which cannot be duplicated without a specific code held exclusively by the manager, that allows access to the reserved Bike Box infrastructure. It effectively activates the opening of the metal box inside the Bike Station. The key is collected directly at the Bike Station from a Keybox, which can be opened using a code provided to the user via email after booking the service. Each key is associated with the individual reserved box. The same key may not be used for more than one bicycle. A deposit (€70.00/key) must be paid for each access key at the time of booking. To access multiple BIKEBOXes, the User must request additional access keys, paying the corresponding deposit for each.

USER: The individual authorized to use the protected and supervised private bicycle storage service called “BIKEBOX-FINALE”, following registration on the dedicated website and receipt of an access code to the Bike Station.

SERVICE DISRUPTION: Any malfunction of technological equipment that prevents the User from using the service. Examples include, but are not limited to: failure to recognize the access code, key malfunction, power outage, etc.

DURATION: The duration of the service depends on the booking made by the User at the time of registration/reservation.

VIDEO SURVEILLANCE: The system used inside the Bike Station to ensure correct use of the service and to carry out security checks and theft prevention.

HELMET STORAGE: The space dedicated to the storage of helmets and small personal items in accordance with the procedures set out in these regulations. The storage service consists of keeping helmets/small luggage in automatic lockers/miniboxes from the day and time of deposit until the day and time of collection.

DEPOSITOR: The individual who uses the Helmet Storage service.

SHOWER SERVICE: The service that allows the User to use the 2 shower rooms located inside the Bike Station.


CONDITIONS

User Obligations

The User undertakes to comply with the following:

a) Before accessing the Bike Station, they must verify that the access code provided by the booking system for using the Keybox is working and that the key granting access to the Bike Box is present inside the Keybox.

b) Once inside the Bike Station, they must park their bicycle inside the assigned Bike Box.

c) Protect the bicycle from theft with an appropriate lock, if necessary securing it to the hook inside the box.

d) Upon leaving, they must ensure the Bike Box access door is closed.

e) The User undertakes to immediately report any anomaly and/or damage encountered during use of the service to telephone number 3389704362. Should the damage be attributable to the User, after the relevant technical assessments, the User shall be required to pay compensation for the damage.

f) Any object or money found in the lockers must be immediately reported to the Manager through official channels. Any form of misappropriation or personal use is prohibited. Violation results in suspension or closure of the account.


Additional Obligations

The User unconditionally assumes the following obligations:

a) To hold a single coded key for each individual Bike Box they intend to access. A single key allows the use of the service for one bicycle only.

b) To keep the coded key with care and not to lend it to third parties.

c) Not to tamper with any part of the technological equipment (access system, video surveillance, etc.). In the event of damage attributable to the User, they shall be required to pay compensation in accordance with the Civil Code and applicable legislation.

d) Not to allow unauthorized persons access to the Bike Station area, and in any case to observe general principles of caution and diligence in using the service.

e) To refrain from parking the bicycle outside the Bike Station.

f) Not to dirty the facility and/or leave waste of any kind, either inside or in its immediate surroundings.

g) Not to remain in the facility longer than strictly necessary for parking the bicycle.

h) Not to claim any right of ownership over the coded key or any other element related to the “BIKEBOX-FINALE” service.

i) To return the coded key at the end of the service booking period by placing it back inside the Keybox.

j) BIKE BOX shall not be held liable in any way for damages suffered by the User, or caused by the User to third parties, as a result of using the “BIKEBOX-FINALE” service, where such damages are attributable to the User themselves.

k) Likewise, the User shall be required to compensate BIKE BOX for all damages caused during use of the service, for whatever reason, where such damages are attributable to the User.


Obligations in Case of Loss of the Coded Key

In the event of loss of the coded key, the User is required to:

  • Immediately notify the number 3389704362;
  • Should the User wish to obtain a new coded key, they must pay the deposit amount again.

In the event of loss or deterioration of the coded key, Bike Box shall retain the deposit paid at the time of booking.


Sanctions and Other Penalties

In the event of use of the bicycle storage facility for purposes other than its intended use, BIKE BOX reserves the right to request the immediate return of the coded key and to exclude the User from the service.

In the event of disposal of personal waste and/or defacement of the facility, BIKE BOX reserves the right to request the immediate return of the coded key with exclusion from the service and possible assessment of a compensation claim for damages caused.

In the event of parking a bicycle inside the Bike Station without using the assigned box, thereby obstructing other users, BIKE BOX reserves the right to remove the bicycle from the storage and transfer it to the Municipal Lost and Found Office.

In the event of bicycle abandonment (identifiable through prolonged non-use of the box), BIKE BOX reserves the right to charge the User for the occupation of the box for the period exceeding the relevant booking period, and to remove the bicycle from storage and transfer it to the Municipal Lost and Found Office.


Helmet Storage Service

BIKE BOX makes available to Users, for a fee, 6 lockable lockers measuring 33 cm x 45 cm x 180 cm for the storage of helmets and small items.

Accepted for storage, within the capacity of each individual locker, are helmets, suitcases, bags, travel bags and similar items. All luggage must be properly closed.

The following will not be accepted for storage:

a) Luggage containing easily flammable, perishable goods, items emitting unpleasant odours, or items that may cause deterioration of the storage infrastructure or damage to other stored luggage;

b) Money, jewellery, precious metals, business documents and other valuables in general;

c) Luggage weighing more than 50 kg;

d) Animals and plants;

e) Items prohibited by law or considered dangerous under national legislation, as well as items that, by their nature or packaging, could cause harm to people, the environment or other stored luggage.

The Customer must ensure the locker door is properly closed before leaving the Bike Station.

The Customer must not leave anything inside the locker when leaving the Bike Station for the last time.

The Customer is responsible for their luggage and its contents.

BIKE BOX is not responsible for the condition of luggage and personal items left in storage.

After 30 days from the last date of use of the storage service, uncollected items shall be considered abandoned and the depositor loses all right to compensation or reimbursement for them. Bike Box may, at its discretion, proceed with the sale and/or destruction and/or retention of the luggage and its contents.

The return of forgotten items shall be entirely at the care and expense of the depositor.

BIKE BOX is not responsible for spoilage and natural deterioration of stored goods not attributable to its own fault or to causes related to storage conditions.

BIKE BOX is not liable in any way for damages or losses due to unforeseen circumstances, force majeure and/or natural events such as, by way of example only, earthquakes, flooding, etc.


Video Surveillance

BIKE BOX uses video surveillance systems solely to ensure safety, protect its assets and prevent unlawful acts. Images are viewed exclusively by authorized staff, the judicial authority or the police.

Video recordings and their use will be carried out in compliance with current legal provisions. The User is made aware of the presence of cameras and their use through appropriate signage placed inside the Bike Station.


Shower Service

BIKE BOX makes available to Users 2 showers with hot/cold water. The service is chargeable and the rates are displayed inside the Bike Station.

The User must use the shower service with the care of a diligent person, ensuring the shower cubicles are not left dirty after use.

BIKE BOX is not liable for damages suffered by the User, or caused by the User to third parties, as a result of improper use of the shower service and/or acts attributable to the User themselves.


Declaration – User Liability

The User declares that they are aware of and accept, without reservation, all provisions and clauses relating to the protected and supervised private bicycle storage service called BIKEBOX-FINALE as set out herein, as well as the Helmet Storage Service and/or the Shower Service, and agrees unconditionally to the requirements and clauses contained in these regulations.

In any case, the signatory is aware that BIKE BOX is not liable:

a) For damages suffered by the User, or caused by the User to third parties, as a result of using the “BIKEBOX-FINALE” service, where attributable to the User themselves;

b) For total or partial theft of the User’s bicycle and for the loss, destruction or theft of objects present on the bicycle stored at the Bike Station;

c) For damages suffered by the User, or caused by the User to third parties, as a result of using the Helmet Storage Service, where attributable to the User themselves;

d) For damages suffered by the User, or caused by the User to third parties, as a result of using the Shower Service, where attributable to the User themselves.


Withdrawal

Should the User wish to withdraw from a booking made, they must promptly notify the number 3389704362.


Jurisdiction

The User acknowledges that any dispute arising from the use of the protected and supervised private bicycle storage service called “BIKEBOX-FINALE”, the Helmet Storage Service and the Shower Service shall fall under the exclusive jurisdiction of the Court of Savona.


Applicable Law

For all matters not expressly addressed herein, reference is made to the Civil Code and applicable legislation.


Authorization for the Processing of Personal Data

The User declares to be informed, pursuant to Legislative Decree 196/2003, that:

a) The provision of data is mandatory both in order to access the protected and supervised private bicycle storage service called “BIKEBOX-FINALE”, and to allow BIKE BOX DI GHISELLINI ALBERTO (hereinafter BIKE BOX) – VIA DOMENICO BRUNENGHI, 39 – 17024 – FINALE LIGURE (SV), VAT number 04015090048, to manage the subsequent procedural requirements;

b) The personal data provided by the User will be processed for institutional purposes connected to or instrumental in the management of the service, the sending of informational, advertising or promotional material relating to the service, monitoring of service performance, in-depth statistical surveys and/or service satisfaction assessments, and statistical processing;

c) The processing of personal data provided by the User will be carried out using both computerized and manual methods;

d) Failure to provide some or all of the requested data makes it impossible to proceed with the delivery of the Keybox access code required to use the service;

e) The data provided may be communicated to other public or private entities for procedural purposes, the carrying out of in-depth statistical surveys and/or service satisfaction assessments, and statistical processing;

f) The declarant may exercise the rights set out in Article 7 of Legislative Decree 196/2003 and subsequent amendments (modification, updating, deletion of data, etc.). The data controller is BIKE BOX DI GHISELLINI ALBERTO (hereinafter BIKE BOX) – VIA DOMENICO BRUNENGHI, 39 – 17024 – FINALE LIGURE (SV), VAT number 04015090048.


Pursuant to and in accordance with Articles 1341 and 1342 of the Civil Code, the User declares that they are aware of and expressly accept the following clauses: Art. 1 (User obligations), Art. 2 (Additional user obligations), Art. 3 (Obligations in case of loss of the coded key), Art. 4 (Sanctions and penalties), Art. 8 (User liability), Art. 10 (Jurisdiction).
